  1. Introductory Provisions
    • This Privacy Policy (“hereinafter referred to asthe “Policy”) governs the processing of personal data in connection with the use of the website www.talentmap.cz and the creation and use of a user account in the TALENTMAP database (hereinafter collectively referred to asthe “Website”) and our other services (hereinafter referred to asthe “Services”) by its users (hereinafter referred to asthe “User”or“You”).
    • The owner and operator of the Website and the controller of personal data pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to asthe “GDPR”) is ACTORSMAP s.r.o., Company ID No.: 08971901, with its registered office at Bělocká 22, 161 00 Prague 6, registered in the Commercial Register maintained by the Municipal Court in Prague under file no. C 328415 (hereinafter referred to as“ACTORSMAP” or “we”).
    • We would like to explain how we collect, process, and protect your personal data, and what rights you have regarding the processing of your personal data when you use the Website or our Services.
  2. Purpose of Personal Data Processing
    • We process only the personal data that you provide to us (e.g., first name, last name, email address). Personal data refers to any information that can be linked to a specific User.
    • The user represents that all personal data provided is true, accurate, current, correct, and complete. ACTORSMAP assumes no obligation to verify this information. If you provide any information that is false, inaccurate, outdated, or incomplete, or if we have reasonable grounds to suspect that such information is false, inaccurate, outdated, or incomplete, we reserve the right to suspend or terminate our cooperation and refuse any current or future use of the Services. ACTORSMAP may, at its sole discretion, refuse to offer the Services to any person.
    • ACTORSMAP’s processing of personal data is lawful because at least one of the following conditions is always met during processing:
      1. you have given your consent to the processing of your personal data;
      2. The processing of your personal data is necessary for the performance of a contract to which you are a party;
      3. the processing of your personal data is necessary to comply with our legal obligation; or
      4. The processing of your personal data is necessary for the purposes of our legitimate interests.
    • ACTORSMAP processes Users' personal data for the following purposes:
      1. Provision of Services and Fulfilment of Contractual Obligations – For the purpose of providing Services and fulfilling contractual obligations, we may process the User’s personal data that the User has provided to us or will provide to us in the future by using the Website or Services. This processing of personal data is necessary for the performance of the contract between the Users, as data subjects, and us.
      2. Sending Newsletters and Marketing Communications – If you have subscribed to our newsletters and marketing communications, we will send you these newsletters and marketing communications from time to time. You may withdraw your consent to receive newsletters and marketing communications at any time. We process your personal data for this purpose based on our legitimate interest or your consent.
      3. To protect our rights – We may process the User’s personal data that is necessary to assert our claims and for our protection. Such processing of the User’s personal data is in our legitimate interest.
    • ACTORSMAP may engage in automated individual decision-making within the meaning of Article 22 of the GDPR; by clicking the “I Agree” button on the Website or by entering into a contract with ACTORSMAP, the User provides their explicit consent to such processing. You have the right not to be subject to automated individual decision-making with legal or similarly significant effects, which also includes profiling.
  3. Retention period for personal data
    • We process and store your personal data only for as long as necessary for the purposes stated above, until you withdraw your consent, or for as long as necessary to comply with all legal requirements. After this period has expired, we will delete or anonymize your personal data. If we process your personal data based on a legitimate interest, the processing will continue for as long as our legitimate interest persists. After this period expires, your personal data will be deleted. You may object to the processing of your personal data based on our legitimate interest at any time.
    • ACTORSMAP may transfer Users’ personal data to other processors that provide it with marketing and other support services, but always in accordance with the purposes set forth above. ACTORSMAP uses third-party services for its operations, in particular internet service providers and other technologies necessary for the proper functioning of ACTORSMAP. You agree that the data we collect from you may be transferred to and stored at a destination outside the European Economic Area. It may also be processed by staff operating outside the European Economic Area who work for us or for one of our suppliers. By submitting your personal data, you consent to such processing. We will take all necessary measures to ensure that your data is handled securely and in accordance with this Policy.
    • The User’s personal data will always be processed to the extent of the data provided by the User, by ACTORSMAP, its employees, and its contractual partners. In the case of contractual partners, the User acknowledges that the User’s personal data may be transferred to and processed by companies providing ACTORSMAP with information technology management, legal, accounting, and tax advisory services. Individual processors are authorized to handle personal data exclusively for the purposes for which they were authorized by the controller and in accordance with the controller’s instructions.
  4. User Rights
    • Your rights regarding the protection and processing of personal data are as follows:
      1. Right of access to personal data – The right of access to personal data means that the User has the right to obtain information from ACTORSMAP regarding whether ACTORSMAP is processing their personal data, and if so, what data is being processed and how it is being processed.
      2. Right to Rectification of Personal Data – The User also has the right to have ACTORSMAP rectify, without undue delay and upon request, any inaccurate personal data concerning the User. The User has the right to complete any incomplete personal data at any time.
      3. Right to erasure of personal data – This right requires ACTORSMAP to delete the personal data it processes about the User if the conditions are met and the User requests it.
      4. Right to restrict the processing of personal data
    • The User also has the right to request that ACTORSMAP restrict the processing of their personal data in certain cases. The User has the right to object at any time to processing that is based on the legitimate interests of ACTORSMAP or a third party, or that is necessary for the performance of a task carried out in the public interest or in the exercise of official authority.
      1. Right to data portability – This right allows the User to obtain the personal data provided to ACTORSMAP in a commonly used, machine-readable format. The User may then transmit this data to another controller or, if technically feasible, request that the controllers transfer the data directly to one another.
      2. Right to File a Complaint and/or Object – If you are dissatisfied in any way with the processing of your personal data by ACTORSMAP, you may file a complaint or object directly with us, or contact the Office for Personal Data Protection. More information about User rights is available on the Office for Personal Data Protection’s website at https://www.uoou.cz.
      3. As a data subject, the User has the right to be informed about the processing of their personal data. This information includes the controller’s contact details, the purpose and legal basis of the processing, information about the controller’s legitimate interests, the recipients of the personal data, the retention period for the personal data, all rights of data subjects, the reason for providing the personal data, as well as information regarding the transfer of personal data to third countries outside the European Union and, where applicable, information on whether automated decision-making, including profiling, takes place.
  5. Privacy Policy
    • ACTORSMAP declares that only persons authorized by us have access to the User’s personal data. We are committed to storing your data securely. Therefore, we have implemented appropriate physical, technical, and organizational measures and plans to protect and secure the data we have collected from you. Our goal is to prevent unauthorized or unlawful processing of your personal data, as well as accidental, unauthorized, or unlawful disclosure, use, transfer, processing, copying, or damage to your data.
    • If we have provided you with (or you have chosen) a password that allows you to access your user account, you are responsible for keeping that password confidential. We ask that you do not share this password with anyone.
  6. Cookies
    • When you use the Website and, where applicable, our other Services, small identification files called cookies are stored on your computer. These files allow us to collect certain information from your device, which we use to improve the functioning of the Website and Services.
    • We do not use any of these identifiers to identify Users as individuals.
    • Users can disable cookies or delete cookies already stored on their computer by adjusting their web browser settings.
    • If a User has cookies enabled in their web browser and visits our Website, they thereby consent to the use of cookies in accordance with this Policy. To the extent that cookies constitute personal data, their processing is governed by the rules regarding the protection of personal data set forth in this Policy.
  7. Final Provisions
    • By checking the consent box on the form, you confirm that you have read this Policy and that you accept it in its entirety.
    • This Policy and any other agreements and legal relationships between you and ACTORSMAP are governed by the laws of the Czech Republic. The general courts of the Czech Republic have jurisdiction over any legal disputes between you and ACTORSMAP.
    • If any provision of these Terms is found to be invalid, unenforceable, or void, we will replace such provision with a provision that most closely approximates the intent and purpose of the original provision. The invalidity or unenforceability of any one provision shall not affect the validity or enforceability of the remaining provisions of these Terms.
    • This Policy takes effect on July 1, 2025.
